MEDIATION FEE SCHEDULE

1. FEES
Philip Mediation is committed to helping parties manage and resolve their disputes as early as possible, and without the need for litigation. As such, we offer reduced pricing and additional flexibility to parties who are not represented by legal counsel, with the goal of facilitating early dispute resolution, allowing parties to maintain or repair ongoing relationships and avoid the emotional and financial costs of a lawsuit. The following fees are applicable for two-party mediations in which none of the parties are represented by legal counsel. (If any of the parties will be represented by legal counsel at the mediation, please refer to the standard Mediation Fee Schedule, or contact me if you require a sliding scale fee.) Fees are usually split equally between the parties. Mediations generally occur Monday - Friday, excluding federal holidays, between the hours of 9 a.m. and 5 p.m. Please contact us for availability and applicable fees if you are interested in scheduling a weekend, holiday or evening mediation, or if your dispute involves more than two parties. a. Pay As You Go – Philip Mediation charges $250 per hour (rounded up in 15-minute increments). There is no minimum time requirement. The amount charged includes travel time within 10 miles of ZIP code 98028, as well as a 30-minute joint pre-mediation consultation with all parties, during which the mediation process will be explained and parties will be given an opportunity to ask questions. In the event that the parties choose to proceed with mediation, payment is due in full at the conclusion of the mediation session. b. Hourly – Philip Mediation charges $225 per hour. Hourly mediations are subject to a 2-hour ($450) minimum. The amount charged includes a pre-mediation consultation with all parties and any travel time within the greater Seattle area. c. Half Day – Philip Mediation charges $800 per half day (4 hours). Matters scheduled for a half-day mediation are generally scheduled to begin at either 9:00 a.m. or 1:00 p.m. The amount charged includes a pre-mediation consultation with all parties, any travel time within the greater Seattle area, and 4 hours of mediation time. Philip Mediation may be available to continue mediation sessions into the afternoon or evening on half-day cases, depending on location and subject to an hourly rate of $200 per hour (rounded up in 15-minute increments) beyond the allotted 4 hours. 2. ADDITIONAL TIME – On hourly and half-day mediations, Philip Mediation reserves the right to charge for any additional time required for preparation and/or follow-up at a rate of $200 per hour (rounded up in 15-minute increments). After the mediation has concluded, Philip Mediation will send a supplemental invoice, which is due and payable upon receipt. 3. TRAVEL TIME – Philip Mediation charges $100 per hour (rounded up in 15-minute increments) for travel time not otherwise included in paragraphs 1(a)-(c) above. On “pay-as you go” mediations, payment for travel time is due at the conclusion of the mediation session. On hourly and half-day mediations, Philip Mediation will send a supplemental invoice after the mediation has concluded, which is due and payable upon receipt. 4. CONVENING – Philip Mediation is available to convene mediations in cases in which the parties are unable to do so themselves. Convening efforts will be conducted by telephone, e-mail, and U.S. Mail, as necessary. A convening fee of $150 will be added to the final invoice in the event that the matter proceeds to mediation. 5. FACILITY COSTS – Conference room facilities must be arranged by the parties. Philip Mediation has access to a number of facilities in the greater Seattle area and can assist in locating a suitable facility; however, the facility fee will be the responsibility of the parties. 6. ALLOCATION OF FEES – All fees will be billed to and are due from the mediation participants in equal shares unless the parties agree to a different allocation and notify Philip Mediation of the agreed-upon allocation at the time the mediation is scheduled. 7. DEPOSIT – On hourly and half-day mediations, the total amount due for reserved time, if any, must be received by Philip Mediation no later than 10 business days prior to the mediation in order to guarantee the mediation date and time. The remaining balance, including additional preparation, conference and/or follow-up time, if any, will be billed to the parties after the conclusion of the mediation, and is due and payable upon receipt. 8. CANCELLATION/POSTPONEMENT – Any hourly or half-day mediation cancelled or postponed within 5 business days of the scheduled date is subject to forfeiture of 50% of the deposit amount, unless Ms. Philip's time can be rescheduled for another matter. 9. PAYMENT RESPONSIBILITY – The parties are jointly and severally responsible for payment of fees and costs. |
